Quelle est la durée légale du préavis contractuel en Belgique ?
En droit belge, la durée du préavis dépend du type de contrat. Pour les contrats commerciaux, le Code civil belge (art. 5.69 nouveau) impose un délai raisonnable sauf stipulation contraire. La loi Breyne impose des délais spécifiques pour les contrats de construction. Tout préavis doit être notifié par écrit ; une signature électronique ne peut pas être privée d'effet juridique au seul motif qu'elle est électronique (règlement eIDAS, art. 25). Le RGPD s'applique dès que le contrat implique des données personnelles.
