Terms and Conditions

These Terms and Conditions ("Terms") govern access to and use of the website and services available at 4mycontracts.net (the "Service"). The Service is provided by 4mycontracts.net ("Provider", "we", "us").

1. Acceptance

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and Accounts

You must have legal capacity to enter into a contract. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. The Service

The Service is offered as a software-as-a-service solution (SaaS). Features may change over time. Some features may be in beta and provided "as is".

4. Subscriptions, Fees, and Billing

If the Service is offered for a fee, you agree to pay the applicable fees and taxes as described at checkout or in an order form. Unless otherwise stated, fees are non-refundable.

Plan upgrades. You may upgrade to a higher-priced plan at any time from your account panel. The upgrade takes effect immediately: the features and limits of the new plan are activated as soon as the upgrade is confirmed. For the billing cycle already in progress you pay only the price difference between the new plan and your current plan, calculated pro rata for the days remaining in the cycle, according to the formula: (price of the new plan − price of the current plan) × (days remaining ÷ total days of the current billing cycle). Your renewal date does not change; starting with the next renewal, the subscription is billed at the full price of the new plan. The amount due at upgrade is charged automatically, at the time of the upgrade, using the saved payment method associated with your subscription.

If you upgrade from a prepaid plan with a longer billing interval (for example an annual plan), or if the upgrade changes your billing interval, the unused value of the remaining period is automatically converted into an internal service credit on your account, which is applied to future invoices of the new subscription until it is used up; during this time you may see no new charges. Service credit is not money: it has no cash value, is non-refundable and non-transferable, and cannot be paid out, consistent with the non-refundable nature of fees under this section. Switching to a lower-priced plan (downgrade) is handled through customer support.

5. Acceptable Use

You agree not to:

  • break the law, infringe rights, or violate privacy;
  • attempt unauthorized access, scanning, or security testing without permission;
  • interfere with the Service, including via malware, bots, scraping, or denial-of-service;
  • reverse engineer, decompile, or circumvent technical limitations, except where permitted by law.

6. Customer Data and Content

You retain ownership of data and content you submit ("Customer Data"). You grant Provider a limited license to host, process, transmit, and display Customer Data solely to provide and improve the Service and to comply with law.

7. Data Protection

If Provider processes personal data on your behalf, the parties may need to enter into a data processing agreement (DPA). You are responsible for ensuring you have a lawful basis to provide personal data to the Service.

8. Intellectual Property

Provider and its licensors own all intellectual property rights in the Service, including software, design, and trademarks. These Terms do not grant you any ownership rights.

9. Third-Party Services

The Service may integrate with third-party services. Provider is not responsible for third-party services and their terms, availability, or security.

10. Availability and Support

We strive to keep the Service available but do not guarantee uninterrupted operation. Any service levels apply only if expressly agreed in writing.

11. Suspension and Termination

We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service and users. You may stop using the Service at any time.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROVIDER DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

To the maximum extent permitted by law, Provider will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill.

14. Indemnification

You agree to indemnify and hold Provider harmless from claims arising out of your use of the Service, your Customer Data, or your violation of these Terms or law.

15. Changes

We may update these Terms. The updated version will be posted on 4mycontracts.net and will apply from the effective date shown.

16. Governing Law and Disputes

These Terms are governed by the laws of Romania. Courts with jurisdiction where Provider is established will have exclusive jurisdiction, unless mandatory law provides otherwise.
